If the Promiser violates the above commitments and guarantees, the Promiser shall hold the Promisee and/or its affiliates (including their respective managers, directors, employees, agents, servant, subcontractors, distributors) harmless from and against any and all damages, suits, claims, judgments, liabilities, losses, fees, costs or expenses of any kind.
